Terms of Use

The Service Administrator provides you access to use the Shchebetar Application (hereinafter also referred to as the Service) by granting remote access to it via the Internet under the terms that are the subject of these Terms of Use for the Shchebetar Application. In this regard, you need to carefully read the conditions of these Terms, which are considered by the Service Administrator as a public offer in accordance with Article 437 of the Civil Code of the Russian Federation.

Terms Used in These Rules

The Shchebetar Application (or Service) – a service designed for user dating.

Administrator – an individual, Nasibullin Sergey, located at: 125183, Moscow, Cherepanov's Passage, 74, 73 is the rights holder and administrator of the Service.

Mobile application (Shchebetar Application) – software available in the app store, App Store, providing users access to the Service.

User – an individual registered in the Shchebetar Application in accordance with the procedures established by these Rules, who has reached the age permitted under Russian legislation for accepting these Rules and possesses appropriate authority and legal capacity.

Status of Terms of Use for the Shchebetar Application

These Terms of Use for the Shchebetar Application (hereinafter referred to as "Rules") are developed by the Service Administrator and define the conditions for using and developing the Service, as well as the rights and obligations of its Users and Administrator.

These Rules constitute a legally binding agreement between the User and the Service Administration, which provides for granting access by the Service Administrator to the User for using the Service and its functionality.

The User is obliged to fully familiarize themselves with these Rules before registering in the Service, as well as with the Privacy Policy and License Agreement of the Service posted at https://serfodi.ru/privacy, https://serfodi.ru/terms. Registration of a User in the Service means full and unconditional acceptance by the User of these documents in accordance with Article 438 of the Civil Code of the Russian Federation.

These Rules may be amended and/or supplemented by the Service Administration unilaterally without any special notification. These Rules are an open and publicly available document posted at: https://serfodi.ru/terms. The Service Administrator recommends that Users regularly check these Rules for changes and/or additions. Continuing to use the Service after changes and/or additions have been made to these Rules means acceptance and agreement by the User with such changes and/or additions.

Status of Shchebetar Application and License Conditions

Rights to the Service belong to the Service Administrator. The latter provides access to the Service to all interested parties in accordance with these Rules and applicable legislation of the Russian Federation.

In accordance with these Rules, the Service Administrator (licensor) grants to the User (licensee) a simple non-exclusive license to use the Service within limits defined by these Rules.

Inquiries, suggestions, and claims from individuals and legal entities to the Service Administrator regarding these Rules and all issues related to functioning of the Service, violations of rights and interests of third parties during its use, as well as requests from authorized persons under Russian legislation can be sent to email SerfodiSoftware@gmail.com or physical address.

Each User may submit a complaint about content or a User violating these Rules through functionality provided in the Shchebetar Application. To do this, a User needs to click on a special button next to the profile of a User who uploaded disputed content or whose behavior violates these Rules, select a reason for complaint, and click on a button – this will send a notification about violation. The Administrator reviews such complaints within 24 hours.

Registration in Shchebetar Application and User Status

User registration is free and voluntary.

Processing of personal data of Users is carried out in accordance with Russian legislation. The conditions for processing personal data of Users are defined in the Privacy Policy of the Service.

After registration, Users have the right to independently use and determine content of their profile for personal purposes.

The Service Administrator does not participate in forming Users' profiles. By placing information in their profile on the Service, including their personal data, Users acknowledge and agree that such information may be accessible to other Users of the Service.

Responsibilities of the Twitter Application User

When using the Service, the User must:

  • comply with the provisions of the current legislation of the Russian Federation, these Rules and other special documents to the Service Administrator;
  • not to provide other Users with access to their own profile or to the separate information contained on it, if this may lead to a violation of the legislation of the Russian Federation and/or these Rules, special documents to the Service Administrator;
  • do not post information and objects in the profile (including links to them) that may violate the rights and interests of other persons and the current legislation of the Russian Federation;
  • keep confidential and not provide other Users and third parties with personal data that became known to them as a result of communication with other Users and other use of the Service (including, but not limited to, home addresses, phone numbers, email addresses, passport data, banking information) and information about the private lives of other Users and third parties without obtaining the appropriate prior permission of the latter;
  • to back up the information stored in the User's profile that is important to the User.

If there are doubts about the legality of certain actions, including posting information or providing access, the Service Administrator recommends that you refrain from carrying out the latter.

The User is prohibited from using the Service:

  • upload, store, publish, distribute and provide access to or otherwise use any information that:
    • contains threats, discredits, insults, defames honor and dignity or business reputation, or violates the privacy of other Users or third parties;
    • violates the rights of minors;
    • is vulgar or obscene, contains pornographic images and texts or scenes of a sexual nature;
    • contains scenes of inhumane treatment of animals;
    • contains a description of the means and methods of suicide, any incitement to commit it;
    • promotes and/or promotes incitement to racial, religious, ethnic hatred or enmity, promotes fascism or the ideology of racial superiority;
    • contains extremist materials;
    • promotes criminal activity or contains tips, instructions or guidelines for committing criminal acts;
    • contains information of limited access, including, but not limited to, state and commercial secrets, information about the private life of third parties;
    • contains advertisements or describes the attractiveness of using narcotic substances, information about the distribution of drugs, recipes for their manufacture and tips on use;
    • may potentially lead to the commission of illegal actions by misleading Users or abusing their trust;
    • contains appeals of a political and (or) agitation nature;
    • and also violates other rights and interests of citizens and legal entities or the requirements of the legislation of the Russian Federation.
  • illegally upload, store, publish, distribute and provide access to or otherwise use the intellectual property of Users and third parties;
  • use the software and perform actions aimed at disrupting the normal functioning of the Service or User profiles;
  • upload, store, publish, distribute and provide access to or otherwise use viruses, Trojans and other malicious programs;
  • use automated scripts (programs, bots, crawlers) to collect information in the Service and/or interact with the Service and its functionality without special permission from the Service Administrator;
  • to carry out illegal collection and processing of personal data of other persons;
  • to reproduce, duplicate, copy, sell, trade and resell access to the use of the Service.
  • in any form and in any way to ask and (or) extort funds and (or) other tangible assets from other Users of the Service.
  • to carry out appeals of a political and (or) agitation nature in any form and form.
  • duplicate your own profile, as well as create more than one User profile;
  • post any other information that, in the opinion of the Administrator, is undesirable, does not meet the goals of creating the Service, infringes on the interests of Users or for other reasons is undesirable for posting on the Service;

The User is personally responsible for any information that he posts in his profile, informs other Users, as well as for any interactions with other Users carried out at his own risk.

In case of disagreement of the User with these Rules or their updates, the User is obliged to refuse to use the Service, informing the Administration of the Service in accordance with the established procedure.

Terms of intellectual property rights

Exclusive rights to the Content posted on the Service

All objects posted on the Service, including design elements, text, graphics, illustrations, scripts, programs, and other objects and their collections (hereinafter referred to as Content), are objects of exclusive rights to the Administrator, Users of the Service and other copyright holders, all rights to these objects are protected.

Except as provided by these Rules, as well as the current legislation of the Russian Federation, no Content may be copied (reproduced), processed, distributed, displayed in a frame, published, downloaded, transferred, sold or otherwise used in whole or in parts without the prior permission of the copyright holder, except in cases where the copyright holder has explicitly expressed your consent to the free use of the Content by any person. Reproduction, copying, collection, systematization, storage, transfer of Content for the purpose of creating a database for commercial and/or non-commercial purposes and/or use of the Content in whole or in any part, regardless of the method of use, without the consent of the Administrator is not allowed.

Liability for violation of exclusive rights

The User is personally responsible for any Content or other information that he uploads or otherwise makes publicly available (publishes) on the Service or with its help. The User has no right to upload, transmit or publish Content on the Service if he does not have the appropriate rights to perform such actions acquired or transferred to him in accordance with the legislation of the Russian Federation.

The Service Administrator may, but is not obliged to, view the Service for prohibited Content and may delete or move (without warning) any Content or users at his discretion, for any reason or for no reason, including, without any restrictions, moving or deleting Content that, in the personal opinion of the Administrator, violates these Rules, the legislation of the Russian Federation The Federation and/or may violate the rights, harm or threaten the safety of other Users or third parties.

The functioning of the Twitter Application and responsibility when using it

Users are responsible for their own actions in connection with the creation and placement of information in their own profile, Violation of these Rules and the current legislation of the Russian Federation entails civil, administrative and criminal liability.

The Service Administrator provides the technical possibility for its use by Users, does not participate in the formation of the content of User profiles, does not control and is not responsible for the actions or omissions of any persons in relation to the use of the Service or the formation and use of the content of User profiles.

The Administrator reserves the right at any time to change the design of the Service, its content, functionality, modify or supplement the scripts, software and other objects used or stored in the Service at any time with or without prior notice.

The Site Administrator can take measures to automatically recognize using computer neural networks and remove inappropriate content uploaded to the Service. At the same time, the Service Administrator does not pre-moderate or censor User information and takes actions to protect the rights and interests of individuals and ensure compliance with the requirements of the legislation of the Russian Federation only after the interested person addresses the Service Administrator in accordance with the established procedure.

The Service Administrator is not responsible for the User's violation of these Rules and reserves the right, at its sole discretion, as well as upon receiving information from other users or third parties about the User's violation of these Rules, to change (moderate), block or delete any information published by the User that violates the prohibitions established by these Rules, suspend, restrict or terminate the User's access to the functionality of the Service at any time for any reason or without explanation, with or without prior notice. The Service Administrator reserves the right to block and delete the User's profile if the Administrator discovers that, in her opinion, the User poses a threat to the Service and/or its Users.

The Service Administrator makes commercially reasonable efforts to ensure the operation of the Service around the clock, but does not guarantee the absence of interruptions associated with technical malfunctions, preventive maintenance. The Service Administrator is not responsible for temporary failures and interruptions in the operation of the Service and the loss of information caused by them. The Administrator is not responsible for any damage to the User's or other person's computer, mobile devices, any other hardware or software caused by or related to downloading materials from the Service or from links posted on the Service.

The Service Administrator has the right to send the User information about the development of the Service and its functionality, as well as advertise their own activities.

Limitation of liability to the Service Administrator:

  • THE SERVICE AND ITS FUNCTIONALITY, INCLUDING ALL SCRIPTS, APPLICATIONS, CONTENT AND DESIGN OF THE SERVICE ARE DELIVERED "AS IS". THE ADMINISTRATOR DISCLAIMS ANY GUARANTEES THAT THE SERVICE OR ITS FUNCTIONALITY MAY OR MAY NOT BE SUITABLE FOR SPECIFIC PURPOSES OF USE. THE ADMINISTRATOR CANNOT GUARANTEE OR PROMISE ANY SPECIFIC RESULTS FROM THE USE OF THE SERVICE AND/OR ITS FUNCTIONALITY;
  • UNDER NO CIRCUMSTANCES SHALL THE SERVICE Administrator OR ITS REPRESENTATIVES BE LIABLE TO THE USER OR TO ANY THIRD PARTIES FOR ANY INDIRECT, ACCIDENTAL, UNINTENTIONAL DAMAGE, INCLUDING LOST PROFITS OR LOST DATA, DAMAGE TO HONOR, DIGNITY OR BUSINESS REPUTATION CAUSED IN CONNECTION WITH THE USE OF THE SERVICE, THE CONTENT OF THE SERVICE OR OTHER MATERIALS, TO WHICH YOU OR OTHER PERSONS HAVE GAINED ACCESS TO USING THE SERVICE, EVEN IF THE SERVICE ADMINISTRATOR HAS WARNED OR INDICATED THE POSSIBILITY OF SUCH HARM.
  • THE SERVICE ADMINISTRATOR OR ITS REPRESENTATIVES ARE NOT RESPONSIBLE TO THE USER FOR LOSSES INCURRED BY THE USER IN CONNECTION WITH THE USE OF THE SERVICE, THE CONTENT OF THE SERVICE OR OTHER MATERIALS THAT YOU OR OTHER PERSONS HAVE ACCESSED THROUGH THE SERVICE.

Final provisions

These Rules constitute an agreement between the User and the Administration of the Service regarding the procedure for using the Service and its functionality.

These Rules are governed by and interpreted in accordance with the legislation of the Russian Federation. Issues not regulated by the Rules are subject to resolution in accordance with the legislation of the Russian Federation.

In case of any disputes or disagreements related to the implementation of these Rules, the User and the Service Administrator will make every effort to resolve them through negotiations between them. If the disputes are not resolved through negotiations, the disputes are subject to resolution in accordance with the procedure established by the current legislation of the Russian Federation.

These Rules come into force for the User from the moment he joins them and are valid for an indefinite period.

If, for one reason or another, one or more provisions of these Rules are declared invalid or unenforceable, this does not affect the validity or applicability of the remaining provisions.
